I hope to see you write more on it.

You wrote:
((this is absurd
on the one hand, Bar Chayim is a talmid chochom, but anyone who knows basic halacha knows that a rav can only rule for his community
many generations of great Ashkenazi rabbonim have upheld the prohibition of kitniyos,))

No, they haven't. And those that have, connected it with the maqom. Only gradually did it fall into a custom of the "edah," and for NO hallachic reason.

((and it's not in our hands to contradict them))

Who's them? There's not a lot of hallachic support for this prohibition. It's only something which developed much later on, and open time, until many Ashkinazi Jews hung onto this humrah, like many humras which don't have much basis in hallacha,...like a galuth security blanket.

((if Bar Chayim doesn't want to follow it, that's his choice, but he doesn't have the authority to revert the gezeira,))

That's the whole point...what gezerah?

Ashkinazi poseqim like the Tur, Hakham Tzvi, & the Ya'abetz all said this was not a gezerah. The Tur said it was an extra humrah. His father, the Ro"Sh, I believe was silent on the issue. The latter two said it was a nonsensical minhag.

((especially since he's a sfardi
he certainly does not have the right to permit this to all Jews
if he couldn't find a reason to explain it that satisfied him, that doesn't prove that one doesn't exist
the Ramo had his reasons,))

One of the fundamental mistakes is that all Ashkinazim must go Ram"a and/or Mishnah Brurah,...and, of course, they don't, or they do, but not always,...and not for any Hallachic reason, but rather hasqafic reasons.

((and that's all there is to it
what's the big deal if everyone respects the other one's minhogim,))

There is no hovah to eat qitniyoth during Pesah. Rav Bar-Hayim points to several sources show us that minhaggei hamaqom stay in the maqom. The minhag in Eress Yisrael was NEVER to refrain from eating qitniyoth during Pesah. If it were, then Sephardim would also have to refrain.

If you send me an e-mail address, I will address the issue of minhaggei Avoth.

((because they know that they have upon whom to rely, even if they don't %100 agree???))Esser Agarothhttps://www.blogger.com/profile/12853681733864707489noreply@blogger.comtag:blogger.com,1999:blog-32118121.post-11738370371360102692007-05-13T19:19:00.000+03:002007-05-13T19:19:00.000+03:00this is absurdon the one hand, Bar Chayim is a tal...this is absurd
on the one hand, Bar Chayim is a talmid chochom, but anyone who knows basic halacha knows that a rav can only rule for his community
many generations of great Ashkenazi rabbonim have upheld the prohibition of kitniyos, and it's not in our hands to contradict them
if Bar Chayim doesn't want to follow it, that's his choice, but he doesn't have the authority to revert the gezeira, especially since he's a sfardi
he certainly does not have the right to permit this to all Jews
if he couldn't find a reason to explain it that satisfied him, that doesn't prove that one doesn't exist
the Ramo had his reasons, and that's all there is to it
what's the big deal if everyone respects the other one's minhogim, because they know that they have upon whom to rely, even if they don't %100 agree???Yehoishophot Oliverhttps://www.blogger.com/profile/16906934928426540018noreply@blogger.com
