בצעד חסר תקדים, נטשו שופטי בית המשפט העליון יצחק עמית, נעם סולברג ודפנה ברק-ארז את כינוס הוועדה לבחירת שופטים זאת במחאה על החלטתו של השר יריב לוין להביא לדיון מומחים שיביעו את דעתם בנושא עקרון הסניוריטי והכנסת מצלמות לישיבות הוועדה. לטענתם, הם לא יכולים להיות בדיון על הסניוריטי בגלל ניגוד העניינים. השופטים צפויים לחזור לדיון על הכנסת המצלמות לוועדה...

...ההערכה היא שהמומחים יביעו דעה התומכת ביוזמת השר לוין לבטל את שיטת הסניוריטי וכן להכניס מצלמות לדיוני הוועדה על בית המשפט העליון.

לדברי שופטי העליון, מדובר בצעד בלתי מתקבל על הדעת: "הוועדה אינה מזמנת גורמים חיצוניים לישיבותיה. כך היה מאז ומתמיד, ועמדתנו היא שאין לשנות מסדרי דיון אלה. נוהג זה מתיישב עם העובדה שכלל דיוני הוועדה מתקיימים על בסיס חומרים כתובים, ועל בסיס ההנחה שהחברים מתכוננים באופן ראוי לישיבות. היא אף מתחייבת מהצורך לעשות שימוש יעיל בזמן הדיונים של הוועדה, שעל שולחנה נושאים רבים".

בתוך כך, אחר הצהריים בג"ץ ידון בעתירה על ביזוי בית המשפט על-ידי השר לוין, בשל העובדה שטרם בחר נשיא לבית המשפט העליון, כפי שהורה לו בג"ץ בצו קודם. כפי שנחשף ב"ידיעות אחרונות" השופט עמית דחה את מתווה הפשרה שהציע שר המשפטים יריב לוין כיוון "שהוא מציב אותו במצב של ניגוד עניינים עצמי". השופט עמית סבור כי העובדה שהוא צריך להסכים, בשמם של שופטי העליון, לדיל הכולל את בחירתו לנשיא העליון מציבה אותו בעמדה בעייתית. לעומת זאת, השר לוין ששואף להגיע לפשרות ולהסכמות שיפתרו את המשבר החוקתי החריף, טוען בתשובה שהוא אינו רואה בעיית ניגוד עניינים בהסכמה לדיל, והוא מוכן להסביר זאת לציבור.

על-פי המתווה שהציע לוין, יצחק עמית, השופט הוותיק ביותר, ייבחר לכהונת נשיא העליון והשופט סולברג יהיה המשנה. לוין ימנה את ד"ר ביטון או ד"ר בקשי כשופט שמרן. בנוסף לוין יבחר את השופטת השנייה לעליון, מקרב שופטות בתי המשפט המחוזי. עמית ויתר השופטים יבחרו מועמד ליברלי ויבחרו בהסכמה חמישה שופטים לבית המשפט המחוזי בירושלים.

יתרה מזאת, על דעתם של לוין ועמית ייבחר נציב תלונות על השופטים, ובכך תיגנז החקיקה בוועדת החוקה של הכנסת אשר הייתה משנה את דרך בחירת הנציב והופכת אותה פוליטית.

פוליטי? בהצעות שר המשפטים מונה שופט ימיני ובג״ץ מונה שופט שמאלני. 

המפלגה של שר המשפטים נבחרה לכהן את הממשלה על ידי העם. בג״ץ לא נבחר אלא זוכה להשתתף בבחירות השופטים החדשים.

איך זה לא פוליטי?

הרבה פעמים אני מדגיש כמה חשוב העצמאות של ישראל ובמיוחד עצמאות מארה״ב. אישית אני לא מעריץ את ארה״ב. גלותה חזקה המון יהודים עדיין מלוכדים בצפורניה.

בצד השני חשוב להדגיש שארה״ב היא הכי דמוקרטית שיש בעולם. אם רוצים מדינה דמוקרטית אמיתית אז חייבים לחקור את מערכתה ממשלתית כדי ללומד על דמוקרטיה אמיתית.

יש לארה״ב הפרדת הרשויות אמיתית. לפי מערכת של איזונים ובלמים הנשיא בוחר את השופטים ויש לסנטורים (הנציגים של המדינות) רשות לאשר או לדחות את בחירותו. אין לשופטים שום זכות להשתתף בתהליך.

השינויים למערכת המשפט הישראלית על ידי נשיא בית המשפט העיון אהרון ברק הפכו אותה להיות אוֹלִיגַרְכְיָה, שהיא שלטון המעטים על הרבים.

מומחים כן מוזמינים להגיע ולהעיד בסנט ואפילו על הכשרות של מועמדים לשופט בבית המשפט העליון.

מערכת שטיפת המוח שהתחילו להקים הציונים הסוציאליסטים לפני שבעים ושבע שנים חזקה מאוד.

קל וחומר אי אפשר לשכנע את ילידי הארץ ורוב עולים חדשים שדמוקרטיה היא לא מערכת יהודית בכלל אלא יוונית. אי אפשר לשכנע אותם אפילו בחג חונכה החג שמציין את ניצחון התורה נגד התרבות היוונית.

Judges on the Judicial Selection Committee informed the Justice Minister they oppose summoning external experts to their meetings.

Supreme Court judges who are members of the Judicial Selection Committee have sent a letter to Justice Minister Yariv Levin and other committee members, clarifying that they will refuse the summoning of external experts to the committee.

"The committee does not summon external entities to its meetings. This has always been the case, and our position is that there is no need to change these procedural norms," the judges wrote...

...They further added that "This practice aligns with the fact that all committee discussions are based on written materials, under the assumption that members prepare adequately for meetings. This is also necessitated by the need to use committee discussion time efficiently, with many issues on the agenda."

In the initial phase, committee members are expected to discuss the selection of a Deputy President of the Supreme Court, followed by the selection of a President. During the discussions, a vote is supposed to take place concerning broadcasting the committee's proceedings for selecting a Deputy President.

Political? In the proposal by the Minister of Justice appoints a right-wing judge and the High Court appoints a left-wing judge?

The party of the Minister of Justice (Likud) was elected to serve in the government by the people. The High Court was, and is, not elected, but gets to participate in the selection of new judges?

How is this not political?

I often emphasize how important Israel's independence is, and especially independence from the United States. Personally, I do not admire the United States. Its diaspora is strong, and many Jews are still trapped in its clutches.

On the other hand, it is important to emphasize that the United States is the most democratic country in the world. If you want a truly democratic country, then you must study its system of government in order to learn about true democracy.

אתם כבר שמעתם על ביטול תפילות יום הכיפורים הציבוריות בתל אביב. בשנה שעברה היו עימותים שהפריעו למשתתפים להתפלל בתפילות ציבוריות יום כיפור.

סגנית ראש עיריית תל אביב מיטל להבי מתחה ביקורת על יוזמת התפילות הללו מבחינת ראש גלות מערבית הרגיל, כלומר ראש לא יהודי, מבחינת השקפה שהיא ושאר התינוקות הנשבות וצאצאי הערב רב כל כך דבוקים בה. מי יכול להבחין בין מי זה למי הוא בימים אלה?

כפירת סמכות התורה שבעל פה, הברירה והבחירה של איזה מצוות לקיים ואיך לפי דעתם מוכיחות שהתנועה הרפורמית אינה יהדות בכלל.

להאמין בחפותו של התנועה הקוסרבטיבית היא משחקת במצוות. מבחינת חשוד בה אז היא מסלפת מצוות או מתעלמת ממה שהיא לא אוהבת. התבטאות השיטה גם לא יהדות. שאלה נוספת האם מנהיגי התנועה הקוסרבטיבית באמת מאמינים שלוועדם לענייני חוקים ותקנים יש מעמד של הסנהדרין? סתם מסוקרן.

למרות מסע הפרסום העצום שלוחץ ליהודים לקבל שקיימים כל מיני זרמים דתיים ביהודות אין דבר כזה.

לא יכול להיות שסגנית ראש העיר מדברת על יהדות, אלא על הדת האזרחית של הדמוקרטיה. לצערנו, הרבה יהודים גם מאמינים בה. האם אתם זוכרים את החג המפורסם שלנו שנקרא חנוכה? באילו יהודים נלחמו אחד בשני על הדת? השמאל ואפילו של הימין המתון ממשיכים ללסלף את משמעות החג. ואנו ממשיכים להאבק אחד עם השני. המתיוונים למען הדמוקרטיה ושומרי תורה ומצוות למען היהדות.

בשבוע שקדם למתקפה הרצחנית של חמאס בעוטף עזה מדינת ישראל סערה סביב החשש מהתנגשויות שילוו את הקפות שמחת תורה, וזאת בעקבות עימותים קודמים שפרצו בתפילות יום הכיפורים. עד לאחרונה, טראומת המלחמה המתמשכת דחקה את האירועים הסוערים הללו לשולי הזיכרון, אבל עתירה שהגישה לאחרונה עמותת ראש יהודי בראשות ישראל זעירא, המבקשת שבית המשפט יורה לעיריית תל אביב להתיר לה לארגן את תפילות יום הכיפורים המתקרב בהפרדה מגדרית, החזירה את הנושא לסדר היום הלאומי....
תירוש ממשיכה לכתוב על הניסיונות של הממשלה לפגוע בהפרדת הרשויות. לדתי לא מדויק איך היא מציגה את הענייין. מבחינתי הנה הסיפור האמיתי.

הפרדת הרשויות כביכול הגיעה לקצה בשנות ה-90 ברגע שנשיא בית המשפט העליון דאז אהרון ברק יישם את תכניתו. התכנית כל כך ערמומית שאפילו למבריקים בממשלת ישראל פיספסו את הגעתה, עד שהיה מאוחר מדי להפוך אותה.

אז לבסוף, בדצמבר 2022, הוקמה ממשלה שנבחרה באופן דמוקרטי שהבטיחה רפורמה בשיפוט לקראת הבחירות, ובכך יכולה לעצור את אליגרכית (שלטון המעטים על הרבים על ידי) בית המשפט העליון של ישראל.

שר המשפטים יריב לוין (הליכוד) הוביל אז את ניסיון להגביל את כוח ההשתלטות מדי של בית המשפט העליון. במהלך השנים בית המשפט העליון התערב בענייני הדת כולל הכשרות, הגיור, ולאחרונה למי יש זכות להצביע בבחירות לרבנים הראשיים למדינה, והיום איך יהודים מוכרחים להתפלל.

לא הפתיע אף אחד שבית המשפט העליון ביטל את ביטול סעיף הסבירות על ידי הכנסת.

זמן קצר לאחר מכן, חדרו לישראל בסך הכל 6,000 אנשי חמאס ואזרחים פסבדוסטינים וביצעו טבח. הם רצחו את 1,139 איש, חטפו 250 בני ערובה, רבים מהם כבר נרצחו, ושיגור אלפי הרקטות לדרום ישראל.

הוקמה ממשלת חירום, ובמסגרת ההסכם אסור לכנסת להעלות נושאים שאינם ממש קשורים למלחמה, כגון הרפורמה השיפוטית. איזה מקריות!

לדעתי פסיקת בבית המשפט העליון לגבי תפילות יום הכיפור שעבר במרחב ציבורי והפשרה המְצֻוָּה, וביטול האירוע אחר מכן, אני רואה בו את קטע התורה הבא שמנותק לא מ"האופי היהודי" של מדינת ישראל, אלא מעצם קיומה כמשהו יהודי בכלל.

ביטול אירוע התפילות מאכזב, אבל מובן. אני לא מעריך אף אחת מההתנצלות, וגם לא את עניפת דגל האחדות כביכול. אני מעדיף עניפת דגל של קבלת פנים, זה לצד זה בעידוד חזרה בתשובה. כנראה המארגנים לא רצו שיום הכיפורים יהפוך למאבק ציבורי ואז מאפשר חילול השם ברבים.

הבשורות הטובות היחידות שיצאו מזה הן שאף אחד לא יכול להצהיר שפסיקת בית המשפט העליון כניצחון על ידי הדתיים ולמען הדתיים. ברור שיש כאלה שהיו רוצים להאמין היא ניצחון.

Many of you have already heard about the cancelation of public Yom Kippur prayers in Tel-Aviv. Last year's prayers in Dizengoff Square were marked by clashes, disrupting Jews from praying on the holiest day of our calendar.

The denial of the authority of the Oral Torah, the picking and choosing aspects of Torah of the Reform Movement is not Judaism.

At best the Conservative Movement seems to play with mitzvoth (Torah commandments), and at worst distort or ignore mitzvoth which they do not like. This is also not Judaism. During the week before Hamas' murderous attack on the Gaza border communities on October 7, a major controversy was roiling Israel. It concerned the fear of clashes during the then-upcoming celebrations of Simhat Torah that never took place because the war broke out. About two weeks before that festival, Yom Kippur prayers held in Tel Aviv highlighted the political tension between anti-Netanyahu protesters and supporters of the prime minister. The former had been flooding the streets for months, protesting the government's attempts to neuter the Supreme Court and to erode the separation of powers....
I'll end this quote right here, due to what I believe to be an imprecise representation of the attempts at Judicial Reform. Here is the real story, in my view.

The so-called separation of powers met the beginning of its end in the 1990s with then Chief Justice Aharon Barak's implementation of his long game coup d'etat. This sneaked up on even the brightest within the Israeli government, until it was too late to turn it around.

Then finally, in December, 2022, a democratically elected government which had promised Judicial Reform, and thus putting a stop to the oligarchy that is Israel's High Court, was installed.

Justice Minister Yariv Levin (Likud) then led the attempted neutering reining in of the High Court's overreaching power, which included the religious realm, having stuck its noise into the issues of kosher certification, conversion, just recently who should choose the State's Chief Rabbis, and now how Jews should pray.

In June, Muslims were allowed a gender-segregated prayer event in Tel-Aviv for the Id Al-Adha holiday. Even more of a slap in the face of observant Jews is that Id Al-Adha commemorates the Muslim's belief that Abraham offered Ishmael to be sacrificed, a direct contradiction of the Torah.

Is this brazen example of double standards, indicative of what appears to be Israel's High Court intention to define what Judaism is.

The first of three Judicial Reform proposals, the repeal of the Reasonableness Clause, passed. The Reasonableness Clause allowed the High Court essential to strike down any law a majority of the democratically-elected Knesset (parliament) had passed.

The High Court struck down the Knesset's repeal of the clause. No surprises there. 

Shortly afterwards, Israel was infiltrated by a total of 6,000 Hamas members and Pseudostinian civilians, resulting 1,139 deaths, 250 hostages, many of them have already been killed, and the thousands of rockets into the South of Israel. An emergency government was formed, and as part of the agreement, the Knesset may not bring up any issues unrelated to the war, such as the Judicial Reform proposals. How convenient!

So, now the democratically-elected government which fulfilled its promise to those who voted it into power, is back to square one.

In contrast, Yofi Tirosh seems to see Judicial Reform as cover for advancement of Messianic occupation, as evidenced by gender segregated prayer taking place in public spaces. I actually wish that I could agree with her. But what she sees as messianic forces, I see as rabbis who are trying their best to reach disenfranchised Jews to encourage them to give their people's heritage a chance. If Tirosh wants to see "messianic forces," she should visit certain towns in Samaria.

As far as the High Court's ruling of a compromise, and the public prayer event's cancelation goes, I see it as next fragment of Torah chipped away not from the State of Israel's "Jewish character," but from its very existence as a Jewish entity.

The cancellation was disappointing, but understandable. Although I do not appreciate any of the apologetics, nor the banner of unity, as opposed to a banner of welcome, side by side with the encouragement of collective teshuvah (repentance), the organizers did not want Yom Kippur to turn into a public fight, and potential hillul HaShem (desecration of The Almighty's name).

The only good news to come out of this was that no one could get away with branding the High Court's ruling as a victory for and by religious Jews. Although I am sure that there were some who would have liked to.

Stay tuned to see what happens next year. Although Hanukkah candle lightings will unlikely attempt any gender-segregation, do not discount the possibility of protests against public, Jewish observance, emphasis on Jewish, not in Tel-Aviv.

I guess there is more good news to report, there are countlessly more visibly religious Jews residing in Tel-Aviv, than when I lived there in תפנ״ז-תשפנ״ט/1997-1999.

Let us prayer that this trend continues, undermining the Erev Rav's program to decrease Jewish influence and increase its voter base.

זה בא ממי שאין לו שום מושג מהי ציונות, או אולי שמקורותיה בתורה שבכתב, שהרפורמים אוהבים לתמרן ולפרש אותה לפי רצונות ליבם.

אני מצהיר אותו הדבר לגבי האוקראינים הלא-יהודיים, שחוץ מהמאפיה שלהם, נראה שהם מתנהגים יפה יותר, או חכמים יותר בהסתרת התנהגותם מאשר הסודנים והאריתראים.

עד כאן אני לא חשבתי שנתניהו רואה את מאי גולן כאיום. בעבר נראה שהוא הרגיש מאוים על ידי משה פייגלין, השגריר לשעבר דני דנון, השגריר גלעד ארדן או השגרירה ציפי חוטובלי. את שלושת השגרירים נתניהו שלח מהארץ, אם כי רק פתרון זמני. את משה פייגלין הוא הצליח לדחוף החוצה, לפני שהתחזק יותר מדי. פייגלין ניסה לעבוד לפי הכללים, מה שהקל על נתניהו להכשיל אותו.

כעת יש לנו התשובה, או לפחות חלק מהתשובה, למה נניהו בחר את מאי גולן להמנות קונסול בניו יורק.

נראה שנתניהו בחר אותה כדי לעבוד עליה עד שהיא נכשל. פשוט התפלאתי שהוא לא אפשר למינויה להתקדם יותר כדי להגדיל את כישלונה.

כמובן, איננו יכולים לומר את כל זה בוודאות. נתניהו גם יכול להיות סתם משווק לשמאל היהודי האמריקה. (כמה אחוז מהם באמת יהודים כיום? מי יודע?)

כל זה רק... השערה.

U. S. officials have made the same criticisms of Golan, reading from the scripts of their fellow globalists in Israel, the same officials which have opened up the U. S.'s southern border. Let the U. S. take in the Sudanese and Eritreans. 
US calls possible new Israeli consul's rhetoric 'particularly damaging'

Past comments made by May Golan, who has reportedly been offered the position of Israel's consul-general in New York, are "particularly damaging", US State Department deputy spokesperson Vedant Patel said on Friday morning.
Golan has stated in the past that she is "proud to be a racist" and has repeatedly attacked African asylum seekers living in Tel Aviv.
The only "racism" Golan has displayed has been differentiating between Jews and non-Jews. And why didn't these "refugees" stop in Egypt? Because the Egyptians were not having it. Furthermore, if anyone is racist, it is the Arabs. But we are not allowed to talk about that. It was made clear to the refugees infiltrators that the Egyptians aren't suckers like we Israelis are. Of course, those who are actually calling the shots in Israel leaders want us to remain in a state of chaos. They want to show its citizens that they need them. These are parallel to the globalist, anti-nationalist agenda, which will result in the destruction of anything Jewish within the supposedly Jewish state.

This coming from someone who has no clue what Zionism is, or perhaps even that its origins in the very Written Torah, the Reform love to manipulate and interpret to their hearts desires, in spite of the Torah.

As long as those in the secular, mostly Ashkenazy, elite in Israel continue to treat Jewish Ethiopians as second class citizens, they have a lot of hutzpah (nerve) calling anyone a racist.

Golan first entered the public eye as a campaigner against African asylum seekers. She is known for her staunchly right-wing ideology and previously designated herself “the mother of politically incorrect.” She is also a firm supporter in the camp of Justice Minister Yariv Levin. (JNS)
It had always seemed surprising that Netanyahu was as threatened by Golan as he has been in the past by Moshe Feiglin, former Ambassador Danny Danon, Ambassador Gilad Erdan, or Ambassador Tzippy Hotovely. The latter three Netanyahu sent away, albeit just a temporary solution. Moshe Feiglin he was able to push out, before he got too powerful. Feiglin tried to play by the rules, which made it easy for Netanyahu.

We now have our answer, or at least part of our answer, regarding Golan.

It was to set her up for failure. I was just surprised that Netanyahu did not allow her appointment to go further in order to heighten her failure.

Of course, we cannot say this for certain. Netanyahu could also just be pandering to the Jewish American Left. (What percentage of them are actually Jewish these day? Who knows?)

This is all just... speculation.

הבג״ץ נגד העם / Israel's Supreme Court Versus the People

ממשלת מדינת ישראל החדשה שהושבעה החלה בתהליך של רפורמה משפטית שהבטיחה לעשות לקראת בחירתה.

האופוזיציה המתנגדת לתורה* התעצבנה כי הפסידה את מה שהיא רוצה: כוח ושליטה.
*הביטוים שמאל וימין הם באמת חסרי משמעות בישראל, ובכך מתנגדת לתורה. הממשלה הנוכחית אינה פועלת למען התורה, אך יש בה כמה פעילים למען התורה.
מחאות מתקיימות. נשיאת הבג״ץ אסתר חיות מצהירה כי הרפורמה המשפטית מאיימת על הדמוקרטיה בישראל.

זה פשוט לא נכון. אדרבא, הרסן במערכת המשפטית גורם למדינת ישראל להיות ממש יותר דמוקרטית.

רוב הישראלים הצביעו לממשלה הזו. ארבע סיעותיה המקוריות, הליכוד, הציונות הדתית - עוצמה יהודית, יהדות התורה, וש"ס, הביעו כולן רצונות לרפורמה משפטית במהלך מסעותיהם.

זאת אומרת הם נראים לקיים את הבטחות שהבטיחו לקראת הבחירות.

בתגובה להצהרת נשיאת הבג״ץ, שר המשפטים יריב לוין (הליכוד) מתח עליה ביקורת לגבי הדיבורים הפוליטיים שלה ושאל אותה איך קוראים למפלגה שלה.

אין צריך לומר שנשיאת הבג״ץ לא אהבה את מה שהוא אמר.

לפי ההסכם בין מפלגת ש"ס לראש הממשלה המיועד בנימין נתניהו (הליכוד), חוק עבר על ידי הממשלה לאפשר לאריה דרעי (ש"ס) להמנות שר בממשלה.במסגרת ההסכם בין ראש הממשלה המיועד בנימין נתניהו (הליכוד) לש"ס להצטרף לקואליציה, הממשלה עלתה חוק המאפשר לאריה דרעי (ש"ס) להמנות לשר בממשלה וחוק עבר. בית המשפט הגבוה לצדק (בג"ץ) ביטל את החוק החדש. למעשה, פסק הדין היה פה אחד. אבל, אם העם בוחר ממשלה שהבטיחה ליישם משהו שרוב העם רוצה, למשל רפורמה משפטית, ואז בית משפט מונע מהממשלה מלקיים את הבטחה, בית המשפט הזה מונע מהממשלה מלקיים את רצון העם. אז מה המניע של בג"ץ? להגן על זכויות המיעוט?

*רבים מאמינים שהיא רק בובה של השופט העליון לשעבר אהרון ברק, כפי שלדעתם הייתה קודמתה דורית בייניש.

בתי המשפט בישראל מבטלים שוב ושוב את זכויותיהם של קהילות מיעוטים, כגון ההחרדים והמתנחלים ביהודה ושומרון. בצד השני הפליטים המסתננים האפריקאים הלא-יהודים, העובדים הזרים, (הלא-יהודים), האוקראינים הלא-יהודים, שמספרם שמועלה בחזקה יום יום, ממש מתחת לאפינו, ממשיכים לקבל עוד זכויותיהם על ידי בתי המשפט.

בית המשפט אינו יכול לטעון בתירוץ של הגנה על זכויותיהם של קהילות מיעוטים. מפני שהם עושים זאת באופן בררני. בית המשפט פשוט פועל כממשלה כדי לקדם את המטרות ויעדים שלהם לדלל או אפילו למחוק את האופי היהודי של מדינת ישראל הדמוקרטית.

ישראלים ממשיכים להצביע לממשלות שממנות את פעילויות של הקיהלות החרדים והמתנחלים. אם לא היינו רוצים שהמימון הזה יימשך, או לא חשבנו שאלו שווים את המחיר של השגת יעדים אחרים, שהממשלה הבטיחה לנו, אז לא היינו מצביעים להם שוב פעם.

זה קרה כבר הרבה פעמים מתקומת מדינת ישראל של היום... חכו שנייה. גם הממשלות שבשליטת מפלגת העבודה מימנו את החרדים והמתנחלים נבחרים, בתמורה לתמיכתם הפוליטית.

אמש למעלה מ-100,000 הפגינו בתל אביב. רוב תושבי תל אביב לא הצביע לממשלה הנוכחית עם הרוב. יו"ר האופוזיציה יאיר לפיד (יש עתיד) טוען שהמפגינים באו להגן על המדינה, על הדמוקרטיה, ועל בתי המשפט.

האמת היא שהם באו להגן על פעילות בתי המשפט המועילה להם, ושממשיכה להנכות את עם ישראל בדרך להיות כמו כל האומות האחרות בעולם. להיות לא יהודי.

איפה היו ההפגנות בירושלים? לא היו כאלה. אפילו לא התאמצו להקפיץ מפגינים לירושלים בשבת, כפי האסטרטגיה הרגילה שלהם.

בואו נראה אם ש"ס תפרוש מהקואליציה הממשלתית, מאחר שדרעי לא יוכל לכהן עוד בתפקיד שר בממשלה.

האם מניעת מאריה דרעי להמנות לשר בממשלה פשוט מכשול לתהליך הרפורמה המשפטית? האם נשיאת הבג״ץ חיות מהמרת על כך שהממשלה תכשל בסוף?

האם ח״כים של ש"ס מחכים בסבלנות עד שממשלת נתניהו תמשיך ברפורמה המשפטית ותמנה מחדש את דרעי לשר בממשלה?

איך יכול להיות שפסק דין הבג"ץ היה בפה אחד? האם השופטים מודאגים מהאובדן של כוחם? או נשיאת הבג״ץ מחזיקה סודות כדי לסחוט ולנצל אותם?

האם מעשה ביטול חוק דרעי פשוט מעשה נקמה על ידי חיות? או מעשה כנגד האיום להפחית את משמעות כוחה של אסתר חיות אהרון ברק*? *רבים מאמינים שאסתר חיות היא פשוט בובה של נשיא הבג״ץ לשעבר אהרון ברק כמו דורית בייניש ואחרים כמוה.
The newly sworn-in Israeli Government has begun the process of judicial reform that it promised to do during the run-up to its election.

The anti-Torah* opposition has gotten upset, not getting what it wants: power.
*The terms left and right are truly meaningless in Israel, thus "anti-Torah." The current Government is not pro-Torah, but does have some pro-Torah elements.
The Chief Justice of the Israeli Supreme Court, Esther Hayut, declares that the Government's judicial reforms threaten democracy itself. 

This is simply not true. Rather, reining in the court moves us closer to a democratic system of government. 

The majority of Israelis voted in this government. Its four original factions, Likud, Religious Zionism - Jewish Strength, United Torah Judaism, and Shas - Torah Observant Sephardim, all expressed desires for judicial reform during their campaigns. 

In other words, they appear to be fulfilling their election promises.

In response to the Chief Justice's declaration, the newly appointed Minister of Justice Yariv Levin (Likud) called her out for being political, asking her what the name of her political party is.

Needless to say, she was not pleased.

As part of the coalition agreement between Shas and Prime Minister-designate Binyamin Netanyanu (Likud), the Government passed a law allowing Aryeh Deri (Shas) to become a cabinet minister.

The Israeli Supreme Court (Bagatz) quashed the new law. In fact, the ruling was unanimous.

But, if the people elect a government which has promised to implement something that the majority of the people want, such as judicial reform, then a court which stands in the government's way, is standing in the way of the will of the people.

So what is the High Court's motivation? To protect the rights of the minority?

Well, the courts in Israel have repeatedly chipped away at the rights of minority communities, such as Haredi (ultra-orthodox) and so-called settlers in Judea and Samaria. Whereas non-Jewish, African refugees infiltrators, foreign workers, non-Jewish Ukrainians, the numbers of which seem to be increasing exponentially, right under our noses, continue to have their rights propped up and increased. 

The court cannot use the excuse of protecting the rights of minority communities. Since they have been doing so selectively. They have simply been legislating from the Bench, in order to further their agenda to diminish, if not entirely eradicate the Jewish nature of the deMOCKratic State of Israel. 

Like it or not, Israelis have continued to vote in Governments which choose to fund Haredi and settlement activities. If we did not want such funding to continue, or did not think that these were worth the price of obtaining other objectives, promised by the government, then we would not re-elect them.

This has happened plenty of times over the modern State of Israel's history. Oh wait. The Labor controlled coalitions have also often funded Haredim and select settlers, in exchange for their their political support.

Last night, over 100,000 protestors arrived in Tel-Aviv, the population of which did not vote with the majority. Opposition leader Yair Lapid claims that they came to defend the country, democracy, and the courts.

The truth is that they came to defend the courts' legislative advocacy which benefits them, and which continues us down the path of being like any other non-Jewish nation of the world.

Where were the protests in Jerusalem? There weren't any. The leftist machine did not even bother to bus in their pawns on Shabbat, its usual course of action.

Now we wait to see what will happen.

Will Shas withdraw from the government's coalition, since Deri can no longer serve in the capacity of cabinet minister?

Was the High Court's prevention of Aryeh Deri from becoming a cabinet minister simply an obstacle to the process of judicial reform? But isn't this futile unless the Court had another trick up its sleeve? Or is Hayut betting on the Government eventually imploding, which it might.

Will Shas be patient while PM Netanyahu proceeds with their judicial reforms, and repass the law allowing Deri to become a cabinet minister?

How was it that the High Court was unanimous? Are the other justices also concerned over the potential loss of their power? Or does Hayut have some kind of hold over them?

Was this all a simple act of נקמה (revenge) on Hayut's part? Or was this truly a play against the threat to significantly reduce her Aharon Baraq's* power.?
*Many believe that Esther Hayut is just a puppet of former Chief Justice Aharon Baraq, just like Dorit Beinish, and others were before her.

Saturday-Sunday Weekend for Israel?

Jewish Home party MK Yinon Magal has tabled a bill that would make Sunday an official day off in Israel, in a move that is likely to reignite debate over the somewhat controversial topic.

This is not the first time it has been suggested to extend the weekend to Sunday, with previous attempts being shot down by opponents who contend adding to the weekend would seriously harm the Israeli economy.

Currently, weekends in the Jewish state are from Friday-Saturday, the latter of which is the Jewish Sabbath. But while having Fridays off enables religiously-observant Jewish families to adequately prepare for Shabbat, it also means there is no "day off" as there is in other countries, since Shabbat-observant Jews are prohibited from performing many activities such as driving or otherwise traveling long distances, and spend Fridays preparing for Shabbat as opposed to spending time with their families.

Some have also argued that making Sunday a day off would boost the domestic tourism and leisure sector, with Shabbat-observant families freer to enjoy attractions throughout the country. Others have suggested it could even boost Shabbat observance among "traditional" Israelis, who would in theory observe the holy day if they had more time to engage in leisure activities on Sunday.

In a statement, Magal - who is a non-observant Jew - emphasized both the social and economic benefits of his bill, further noting it would provide "equality" between observant and non-observant Jews.

Addressing the question of how the lost working hours to the Israeli economy would be made up - given that observant Jews cannot practically work more than half a day on Fridays - Magal's bill suggests half a days'-worth of hours be made up by extending working hours Monday-Thursday, with the remaining made up by a half-day on Fridays.

"In a state which sanctifies the Sabbath and limits public transportation and sporting events, it is important to advance a day-off on which no citizen feels that their freedom is limited," Magal said.

Jewish Home Anglo Forum Chairman Jeremy Saltan praised the proposed bill.

"Many of us olim miss our Sundays off," he said. "I want to thank Yinon for moving forward with this important issue. I think there is a real chance this time to get it done."

Where exactly IS Naftali Bennett's kippah?
Is MK Yinon Magal perhaps suggesting that one may be creative as to how one keeps Shabbath?

Um,...no.

The Oral Torah is quite specific as to what is required of Jews to keep Shabbath. Sorry, Yinon Magal, but you cannot say you "love the Torah," and then ignore half of it.

Besides Shabbath, there are mitzvoth such as eating only kosher food, family purity, tefillin, and countless other non-optional commandments, such as not putting a stumbling block in front of other Jews, and even more so, not actively leading them to sin.

When the government allows stores to be open and transportation to run on Shabbath, non-kosher food to be sold in stores and in restaurants, those in the government supporting these policies, such as MK Elazar Stern (Yesh Atid) who should know better, with that kippah on his head, are violating the Torah.

Calling such policies "pluralistic" or "democratic" do not magically make them OK.

And if that was not clear enough for MK Magal, there is no such thing as religious fairness in the Torah. There is truth, and there are lies. Jews are to keep the entire Torah. Non-Jews are to keep seven mitzvoth. There is no in betweens, no compromises. The only pluralism in Torah-observance may be found in our customs alone.

Quite frankly, it also seems that making it easier for Israel's "Christian citizens" to observe their day of rest. That couldn't possibly be because of their "love" for us and their validation of our, could it? What about their money pouring into Israel?

As I recall, the last time this proposal reared its ugly head was in תשע״א/2011, by none other than MK Yariv Levine and kippah-wearing MK Ze'ev Elkin (Likud).
MK Levine explained that the law would enhance Israel’s integration into the global market and synchronize Israel’s trade days with the international standard. The move will also increase private consumption and assist the tourism sector and other services. (Arutz 7)
Another reason which was given for the addition of Sunday as a non-workday was to "help" the religious community.
The initiative would allow Israelis to have a holiday from work on Sundays, while also being able to shop and travel on that day. These things are not possible on Saturday, the Jewish Sabbath, on which Jewish religion forbids all forms of work. They are possible in a limited way on Fridays, because shops and transportation close down early in preparation for the Sabbath. (Arutz 7)
In actuality, though, the above reasons are just code for "let's be more like the goyim." This is in ignorance, or perhaps even in spite of, the countless mandates of the Torah to remain separate from the goyim, when we are talking about the prohibition against marrying them or the prohibition against wearing their clothing, we are to remain separate and distinct, and that includes the observance of goyshe feast days..

The Christians are practitioners of foreign worship. And Sunday is their feast day. Therefore, it is forbidden to negotiate with them in the Land of Israel, any Thursday, Friday, or Shabbath. And there is no need to say Sunday itself, which is forbidden in and out of Israel. And thus we accustomed on all of their feast days.
Even in the U. S., Jews make a point of opening their businesses on Sundays to demonstrate that they are not showing regard for the Christian holiday.

And by the way, not that it matters, but will businesses have to pay their employees Shabbath salaries on Sunday? I hate to think what that will do to Israel's economic growth.

Olim miss their two day weekends, huh? Well, all I can say to that is that you can take the Jew out of Galuth (exile), but you cannot away take the Galuth out of the Jew.

With regards to MK Magal, it is apparent that you can say that you love the Torah of Israel, but not have any clue what Torah really means.

No Need for a Referendum on Sovereignty over Judea and Samaria. The Issue has Already been Decided.

While some support putting sovereignty to referendum to voted on by Israel citizens, I was referred to this recent video (Hebrew/English subtitles), put out by Women In Green, promoting candidates which support sovereignty over Yehudah and the Shomron (Judea and Samaria).

We must not make a referendum on sovereignty over Yehudah and Shomron.

We must not vote, in anyway, shape, or form, on sovereignty over Yehudah and Shomron.

This issue has already been decided, and by a higher authority than men.

We must stand behind this truth, declare it, and act upon it. That truth is stated in the Torah.

Eretz Yisra'el (Land of Israel), ALL of Eretz Yisra'el, belongs to Am Yisra'el! There is nothing to vote on. It is not our decision. The decision has already been made. It is an embarrassment that some of these "religious" Zionists support a referendum.

It is important to take a closer look at the figures, included in this video. Do they, themselves really support sovereignty over Yehudah and the Shomron, like Women In Green?

Yisra'el Katz (Likud): The "Green Line?" Why to we insist on even using, let alone acknowledging such ridiculous terminology? Nowhere in the Torah is there a green line. This is a term made up by goyim, and accepted by co-dependent Jews. It is ridiculous, and should by expunged from our vernacular immediately.

The "Territories?" If we are to speak of "territories," then we should speak of the territories of the Tribes of Re'uven and Gad, the Northern segments of the territories of the Tribes of Asher and Naftali, and how have those returned to their rightful owners: Am Yisra'el.

Uriel Ariel (Jewish Home) and outgoing Speaker of the K'nesseth Yuli Edelstein (Likud) and Yariv Levin (Likud) present an approach much more compatible with Torah principles than Bennet.

Ze'ev Elkin (Likud) those "pieces of Eretz Yisra'el over which we all agree belong to us." What's that on his head? A kippah? HaShem has already decided that it does not matter which pieces over which we agree belong to us nor which pieces that the "international community" of goyim agree belong to us. It is not up for discussion. All of those "pieces," agreed upon or not belong to us. Which Torah has he been following, as a "religious" Zionist?

Miri Regev (Likud) means well. The main flaw in her reasoning stated in this video is that she actually expects her own party to follow its own rules. Good luck!

Ayelet Shaqed (Jewish Home)..Hmm...So far, the women are two for two. And the men? Don't ask. And, those MK's not identifying as "religious" also adhere more to Torah principles more so that those who identify as "religious."

Moshe Feiglin (Likud) would actually like to Israel as a Jewish State. Already think it is? Guess again. Then either you don't actually live here, or haven't been taught that the Torah touches every aspect of our lives, not just what we put into our mouths and we so or do not do on Shabbath.

With the opinions by some of the so-called "Religious" Zionists, presented here in this video, there should no longer be any doubt that the State of Israel is from it.

Rabbi Eli Ben-Dahan (Jewish Home) also presents a position, compatible with Torah. But, don't think that this him Ben-Dahan off the hook for the various, silly remarks he has made in the past.

Zevulun Kalfa, Orit Struk, and Shuli Mualem (Jewish Home) , at least in this video, also express views from a Torah based reasoning. Unfortunately, this by far not always the case, at least not for Kalfa, let alone from their other, fellow Jewish Home Party MK's.

Moti Yogev (Jewish Home), wants to adopt the Levy Report, and apply sovereignty to Yehudah and the Shomron. Gee, MK Yogev, ever thought of adopting the Torah Report? Nope, probably not. What's that on his head? A kippah?

Hmm... No mention of Tzippy Hotovely (Likud)? I'm very surprised,...but pleasantly so.

She, like the other Religious Zionist "hero," Naftali Bennett, allow room for granting Arabs citizenship. This position is only a tad better than Danny Danon's ridiculous friendship with Christians, who have been slowly, but steadily sneaking in through the back door of "volunteering," bot out in the field with non-profit organizations, and through serving in the Israeli Defense Froces [IDF] themselves.

But, I digress...

After the 2:45 mark in the video, a bunch of endorsements are thrown in, from various other famous, and infamous people, over whom we are supposed to be impressed. If you would like to sit in front of your computer screens are weed through them, be my guest.

Then, after that, the video becomes even more worthless than you thought it already was. International Law, History, Western logic from the mouths of not only Israeli lawyers, but from non-Israeli, non-Jews, and who knows who else.

The only, I repeat, the only justification for Jewish claims to Eretz Yisra'el is because HaShem says that it belongs to us, and He tells us so via His Holy Torah. This is the only relevant document we need as a people.

Even the anti-Zionist, Neturei Karta believe that Eretz Yisra'el belongs to Am Yisrael. They simply believe that we are not yet to take possession of it, and not to do so in the manner in which we have already attempted to do so.

I may not agree with their position, but I do not ever remember anyone from Neturei Karta calling for a vote on the Torah (חו"ח).
Now what are we going to do about it?

Vote? By voting, we are saying that there is an alternative to the Torah position.

There is not.

Likud Knesset member Yariv Levin presented to Prime Minister Benjamin Netanyahu on Tuesday a draft of temporary legislation that would, among other provisions, allow the state to revoke the citizenship or residency of terrorists and their family members. The bill was drafted at Netanyahu’s request.

According to Levin’s plan, first reported by the daily Yedioth Ahronoth, the state will revoke the citizenship or residency permit of those convicted of terror activities, which it defines to include the hurling of Molotov cocktails, and expel them to Gaza after they’ve served their prison sentence. I am telling you that if this legislation passes, it is only a matter of time, before Israel's Supreme Court strikes it down as "unconstitutional," even though Israel does not have a constitution.

The high court will point out the lack of fairness, in singling out one ethic group. After all, Prime Minister Netanyahu himself had said Israel is the national home of the Jewish people where there are equal rights for every citizen.


The Israeli government will either feign having "no choice" but to alter the language to include ALL citizens regardless of ethnicity or religion, or it will fight with the high court, and eventually lose.

The government will then have the power, that perhaps some MK's have always wanted, to designate Jews as "terrorists," strip them of their citizenship, and expel them from the country.

I do not doubt MK Yariv Levin's intentions. I just do not know how far he has thought this proposal through.

The legislation is also described as temporary. Well, those of us veteran, Israeli citizens all know what "temporary" means:
Temporary: Temporarily temporary, as in until it is decided to be applied to Jews, at which time, it will be permanent, and as per usual, selectively applied.
I predict that Jews who hold the Torah in higher authority than the Government of of the State of Israel, otherwise known as "extremists," will be be targeted. Already then can be thrown into "Administrative Detention," without trial, just like the Arabs.

Temporary: Ending when it no longer serves the objectives of the powers that be. 
Like a friend of mine just reminded me, Netanyahu always likes to appear super-duper, extra industrial strength, "right-wing" before the Likud Party goes to its primaries. So, even more so, this legislation will not be anything like you might think.

I have been talking about the occupation and the settlements from the moral aspect for almost 50 years now. On Friday, during an event at Tzavta (a cultural center in Tel Aviv), I wanted to say something about it from the godly aspect.

If there will not be two states very soon, there will be one state – and it will be an Arab state. And if there is an Arab state, I feel no envy for the Jews who will live in it. It will be one of the most difficult exiles.

Get off Benjamin Netanyahu's case. He is not in control of the government. The Likud's Knesset faction is a faction of radical settlers. Netanyahu is nearly the most leftist person in the Likud's Knesset faction.

The real government in Israel is controlled by the rabbis of the territories, and there is one person to blame for this situation. His name is Yair Lapid, and he has the power to bring this government down whenever he pleases.

The names "price tag" and "hilltop youth" are embellished names. We must look the monster in the eye and call it by its name. We wanted to be a nation like all nations. We hoped that one day there would be a Hebrew thief and a Hebrew prostitute.

We also have Hebrew neo-Nazi groups. There is nothing the modern neo-Nazis in Europe are doing that these groups are not doing here.

The only difference may stem from the fact that our neo-Nazi groups enjoy the support of quite a few nationalistic, perhaps even racist, lawmakers, as well as a few rabbis who provide them with a foundation which I see as pseudo-religious. This is, in my opinion, the great difference between the Jews and the Jews' words.

I considered the comments I made at Tzavta carefully. When I address an audience, I plan for hours and think about every word. I am a man of words. This is my profession.

I only wish this were true!

Possibly, but irrelevant. Like most politicians, I believe that Netanyahu is neither Leftist nor Rightist, but Netayahuist.

 Once again,... I wish this were true! ...well,...some of these rabbis, the ones who put Torah before the State, and no, not all of them do.

Not I! However, Oz does state quiet accurately, the unfortunate truth regarding the Western, assimilationist, Labor Zionist, Ashkenazy, secular elite, a proud segment of the Erev Rav.

Terrorists prisoners released before the end of their jail terms in diplomatic deals and exchanges like the Schalit deal will not receive “acclimation stipends” from the National Insurance Institute (NII), and their eligibility for other NII payments will be limited, according to a bill proposed by MK Yariv Levin (Likud-Beytenu)...

...Levin explained that if it were up to him, he would pass a law simply denying terrorists all NII payments and stipends, forever. However, he explained to Arutz Sheva, the current coalition can be expected to shoot down any such legislation, especially with dovish Minister Tzipi Livni heading the key Ministerial Committee for Legislation, which decides the fate of bills.

He added that attempts to pass legislation cutting off NII assistance to freed terrorists failed in the former Knesset, because of leftist opposition. In the end, a watered-down version of the bill was passed, which cut by 50% some of the stipends they may receive as Israeli citizens. (Read the entire report for the details)

Duh! What on earth should convicted terrorists receive ANY money at all, EVER?!

I mean, even if we were to believe that that criminals can actually be rehabilitated through the Israeli Prison System, and that they should get a stipend, in order to help them reintegrate back into Israeli society, then we would still leave these terrorists out of this equation.

They are all ideologues anyway. Even those who were supposedly coerced into murdering Jews by shooting, poisoning, planting a bomb, blowing himself up, or assisting in some way, so what?!

That's just too bad. They made the wrong choices, and wrong choices have consequences.

A top Israeli minister on Thursday led a delegation of parliamentarians to the Jordan Valley, where he helped inaugurate a new neighborhood in a settlement and vowed to maintain a military and civilian presence in the territory “for all eternity.” Gideon Sa’ar’s statement came mere hours ahead of the arrival in Israel of US Secretary of State John Kerry, who is slated to present a “framework” for a peace deal to Israeli and Palestinian leaders, including a proposal for security arrangements in the valley, which borders Jordan.

“We are here in the Jordan valley out of a recognition that during these days one of the most crucial issues to Israel’s future is at stake,” Sa’ar, the interior minister, told journalists at a lookout over the Jordan Valley named for the late IDF general and Labor Party politician Yigal Allon.

Sa’ar was accompanied by an entourage of deputy ministers and other MKs, including Likud’s Ze’ev Elkin, Tzipi Hotovely, Yariv Levin and Reuven Rivlin [and Miri Regev]; the Jewish Home party’s Eli Ben-Dahan, Orit Struck and Ayelet Shaked; and Yesh Atid’s Dov Lipman and Ronen Hoffman.

The “crucial” issue is where Israel’s border is going to be drawn: whether it will be the Jordan River or, “God forbid,” somewhere near Netanya and Kfar Saba, Sa’ar said, noting that Israel would become a “state with no strategic depth” if it withdrew from the valley.

“The presence of the IDF in the Jordan Valley can’t be a temporary thing; it needs to be for all eternity,” he added, linking Israel’s military presence to the ongoing presence of settlers in the area.

Sa’ar noted that all Israeli governments since the 1970s had built settlements in the Jordan valley, including Labor-led governments, and added: “It needs to be entirely clear that where there will be no settlements, there will be no IDF. Where there will be no IDF there will be no security and there will be terror instead.”

After the impromptu press conference at the lookout, the group continued to the Jordan Valley community of Gitit, where Sa’ar and his companions lent a symbolic hand to efforts to construct a new settlement neighborhood, taking turns hoisting buckets of cement and pouring them into the foundations of a new building.

Thursday’s event was “the right action at the right time,” said Elkin, the deputy foreign minister, evoking the late diplomat Abba Eban’s comparison of the 1967 lines to “Auschwitz borders.” He added that in light of Kerry’s visit and the security arrangements proposed by the Obama administration, the ministers were presenting to Prime Minister Benjamin Netanyahu Israel’s “sole possible response” to the demands made of it.

Lipman, the MK from the centrist Yesh Atid party, told The Times of Israel that his presence and the presence of his fellow party member Hoffman was no indication that Yesh Atid was in favor of recent efforts by some Likud ministers to legislate the annexation of the Jordan Valley. Rather, he said, he was there to “discuss the issues.”

The event was organized by the Caucus for Eretz Israel, a Knesset caucus dedicated to fortifying Israel’s presence in all parts of the West Bank. The minister and the other MKs are also to visit other communities in the Jordan Valley, including a meeting with farmers in the settlement of Tomer.

The West Bank border region has become a sticking point in negotiations between Israel and the Palestinians, with Jerusalem demanding the long-term presence of Israeli troops in the area, a proposal the Palestinians reject.

On Sunday, a bill to annex the Jordan Valley passed a key ministerial committee, drawing condemnations from both Palestinians and Israelis, who said it threatened the future of the talks. Prime Minister Benjamin Netanyahu (left) is expected to thwart the bill becoming law. (cont.)

I won't knock the MK's who went out to pass cement and plant trees, symbolically or not. Interestingly enough, this event took place on the first of the Eleventh Month in the Hebrew calendar, Sh'vat, the day which Beth Shammai believed was the New Year of the Trees, which, of course, we celebrate on Tu (15) b'Sh'vat.
